Description:

Position Summary: Under the close supervision of the Senior Advisor, with some latitude for independent action, the Agency Attorney Interne, Enhanced Rate Equitable Services Request Unit will perform legal work on regulatory matters under the Individuals with Disabilities Education Act (IDEA), New York State Education Law, the New York State Regulations of the Commissioner, and the New York City Public Schools (NYCPS) Chancellor’s Regulations. This position will perform and support the Legal Advisor in the processing of enhanced rate equitable services requests, drafting responses to New York State Education Department (NYSED) inquiries, and the compilation of Special Education Quality Assurance responses. Also, this position will work to ensure the legal mandate of the provision of equitable services. Performs related work.

Key Relationships: Senior Advisor and Director of the Enhanced Rate Equitable Services Request Unit, Docketing Coordinators of the Enhanced Rate Equitable Services Request Unit, Impartial Hearing Office leadership team, Impartial Hearing Office administrative staff, legal associates, law interns, Office of General Counsel Special Education Unit, Office of General Counsel Deputy Counsel – Due Process, Office of General Counsel Special Education Case Management Leadership, NYCPS Division of Inclusive and Accessible Learning and New York State Education Department (NYSED).

 

Responsibilities

 

  • Process enhanced rate equitable services requests and draft response to filers and NYSED Inquiries.
  • Receive, file, coordinate, and review determinations of enhanced rate equitable services requests.
  • Provide support to office administrative staff on all legal matters, including the requirements of the IDEA, Section 504 of the Rehabilitation Act of 1973, NYS Education Law, New York State Regulations 8 NYCRR 200, 201, 279, and NYC Chancellor’s Regulations.
  • Work with the Senior Advisor to draft communications in the form of letters and memos to NYSED pertaining to the administration of enhanced rate equitable services request and NYS law and regulations.
  • Assist Senior Advisor with monitoring the workflow, ensuring compliance with deadlines, and preparing reports and summaries.
  • Analyze issues raised in requests, complaints, determinations in response to requests, and dispositions of NYSED Special Education Quality Assurance complaint findings to identify trends.
  • Assist Senior Advisor in reviewing existing administrative processes and creating comprehensive technical guides for use in training and as reference materials for the office.
  • Perform legal research.
  • Assist the Senior Advisor and Special Education Case Management leadership team in providing trainings.
  • Work with SECM leaders on trainings regarding the Enhanced Rate Equitable Services process. 

 

Qualification Requirements:

 

Minimum

 

Graduation from an accredited United States law school as defined in the Rules of the New York Court of Appeals (Sections 520.3 or 520.5) or admission to the New York State Bar.

 

Note: This class of positions has a maximum two-year term.

 

Plus

In addition to meeting the minimum requirements, individuals must have two additional years of relevant work experience.

 

Preferred

 

  • Excellent written and spoken communication and interpersonal skills.
  • Ability to understand provisions of applicable laws and regulations.
  • Ability to write clearly and concisely.
  • Efficient legal research skills.

 

 

Salary: $78,195 - $82,558

 

(Internal candidates who are selected for this position and who currently hold comparable or less senior positions within the DOE will not earn less than their current salary.)
