Position Summary: Under the supervision of the Director of the Special Education Unit of the Office of Legal Services, with wide latitude for independent judgment and authority, the Special Education Unit Managing Attorney engages in difficult and complex legal work having significant financial, procedural, or policy consequences. Performs related work.

Direct Reports: Special Education Unit Team Leaders, Attorneys and Legal Support Staff
Responsibilities
- Responsible for the training and supervision of team leaders, attorneys and legal support staff from the Office of the General Counsel (OGC).
- Provides training for DOE field and central staff on compliance with federal and state education laws and regulations.
- Confers with special education specialists, technical experts, and other attorneys, including counsel for litigants.
- Conducts legal investigations; administers meetings to confer with schools and other DOE offices to discuss pending special education claims and other special education-related matters.
- Prepares and argues difficult cases and appeals in administrative tribunals and in the courts. Prepares for and/or tries complex cases involving significant precedents, novel and complicated determinations of law and fact, or having significant legal, policy, or financial implications for the Department of Education.
- Supervises attorneys in trial preparation and presentation.
- Supervises legal support staff and attorneys in the investigation of pending special education claims.
- Reviews written work submitted to administrative tribunals.
- Manages case assignments.
- Manages compliance with Federal and State education laws and City polices in the investigation, settlement and/or litigation of all special education claims.
- Collects, reviews, and reports on data related to pending special education claims.
- Responsible for maintaining and reviewing software systems related to the investigation and settlement or litigation of special education claims, to ensure compliance with Federal and State education laws and City polices.
- Analyzes the advisability of presenting witnesses, as well as the admissibility of types of evidence and matters of legal strategy.
- Supervises all aspects of the negotiation and implementation of the settlement of special education claims.
- Reviews, revises, and approves agreements prepared by other attorneys.
- Reviews, revises and approves claims for attorney’s fees.
- Reviews administrative decisions.
- Reviews, revises, and approves requests for pendency.
- Acts as liaison to the Office of the Corporation Counsel for special education matters filed in Federal Court.
- Analyzes, studies, and reports on the effects of City, State and Federal legislation.
Qualification Requirements:
Minimum
Admission to the New York State Bar and four (4) years of recent full-time responsible, relevant, satisfactory legal experience subsequent to admission to any bar, eighteen months of which must have been in the supervision of other attorneys, in an administrative, managerial or executive capacity, or performing highly complex and significant work.
Incumbents must remain members of the New York State Bar in good standing for the duration of this employment.

Salary Range: $110,419 – $126,241+
(Internal candidates who are selected for this position and who currently hold comparable or less senior positions within the DOE will not earn less than their current salary.)
